A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 상해 피고인은 2015. 8. 25. 02:05경 강원 양구군 C에 있는 D편의점 내에서, 피해자 E(28세)와 여러 번 눈이 마주쳐 피해자로부터 “뭘 쳐다 보냐”라는 말을 듣고 피해자에게 “당신은 왜 쳐다보냐”라고 말한 것이 시비가 되어, 순간 화가 나 피해자에게 다가가 주먹으로 피해자의 머리를 1회 때리고, 이를 피해 달아나는 피해자의 팔을 붙잡아 피해자의 목을 잡아 조르고, 플라스틱 콜라 텀블러(총길이 30cm)로 피해자의 몸통 부위 등을 수회 가격하고, 주먹과 발로 피해자의 머리와 몸통 부위 등을 수회 때려 바닥에 쓰러뜨리고, 계속해서 피해자의 머리채를 잡고 편의점 출입문 앞까지 끌고 가 주먹과 배드민턴채(총길이 60cm)로 피해자의 머리 부위 등을 수회 때리고, 다시 주먹과 발로 피해자의 머리 부위를 마구 때리는 등 피해자에게 약 2주간의 치료를 요하는 뇌진탕 및 두피 찰과상 등을 가하였다.

2. Around the same time as the preceding paragraph, the Defendant obstructed the victim’s convenience store business by assaulting E with the victim F (the age of 26) at the above D points operated by the victim F (the age of 26). During this process, the Defendant obstructed the victim’s convenience store business by force by harming the customers who had been customers to enter the convenience store by blocking E in the process, cutting off the convenience store, towing E with the KT &G tobacco advertising board, cutting off the advertising board, and continuously neglecting the advertising board, and making police officers feel a large amount of 20 minutes of the disturbance, such as assaulting them outside the convenience store, and making it difficult for them to enter the convenience store business by force.

On August 25, 2015, at the same place as the preceding paragraph, around 02:16, the Defendant: (a) reported and dispatched at the same time; (b) the police officer H (the age of 51) and security guards I (the age of 49) assigned to the Yang-gu Police Station G police station, who conducted a search and on-site investigation of the case guard against E; and (c) the police officer conducted a multilateral search and on-site investigation.
