Facts of recognition
A. The Plaintiff is a company that provides real estate consulting services, and Nonparty C actually operates on behalf of the Plaintiff, and the Defendant is the representative director of Nonparty D (hereinafter “D”).
The non-party E Co., Ltd. (hereinafter referred to as the “E”) is a company that entrusts the above business to the non-party K non-real estate trust company (hereinafter referred to as the “K non-real estate trust”) in order to carry out an officetel construction project (hereinafter referred to as the “instant project”) on the F land in emulation, and the K non-real estate trust is an executor of the above business.
B. On December 3, 2011, D entered into a design service contract (hereinafter “the first design service contract”) with the Defendant on March 19, 2012, setting the service period from October 1, 201 to July 31, 2012, with the design service cost of KRW 1.1 billion (the intermediate payment shall be paid at the time of completion of the construction permit) for the instant project. C. The Plaintiff entered into a service contract with the Defendant on March 19, 2012 for market research and marketing activities (hereinafter “instant service contract”). If the Plaintiff performed the market research and marketing activities for the instant project, the Defendant paid the Plaintiff KRW 30 million as the service cost on the date of payment of intermediate payment under the design service contract, and if penalty for delay arises, the amount of KRW 300 million should be deducted from the total design service cost, and the design service contract for the instant project shall be determined by the rate of KRW 1.7 billion to be deducted from the total design service cost, and the design service contract for the instant project shall be registered on March 231, 20.
E. Building permission for the instant project was completed on July 10, 2012.
