1. All of the plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. The following facts are recognized according to the respective descriptions of Gap evidence Nos. 1, 3, and 6 (including each number), and the purport of the whole pleadings.
A. The defendant is a company established for passenger transport business, etc., and the plaintiffs are those who retired while serving in the defendant company.
B. Under the wage agreement concluded between the defendant company and the trade union, the hourly ordinary wage and monthly ordinary wage are determined according to the number of years of continuous service of workers. Under the premise that workers in the morning work from 05:00 to 14:00, and from 15:00 to 24:00, workers in the P.M. shall work every nine hours each day, the daily basic wage (hour ordinary wage x 8 hours each day) shall be calculated for eight hours each day, and the daily wage shall be paid every month by adding one hour each day’s overtime allowance and overtime allowance for the P.M., two hours each day’s night work allowance for the P.M., and other weekly holiday allowances for the P.M.
C. As can be seen, the number of workers working in the morning is 18 hours (i.e., 9 hours x 2) on the day on which they move working hours to the P.m. In such a case, under the wage agreement, the worker is deemed to work for 2-day working hours by 9 hours per two-day working hours (=8 hours x 2 days) and pays an allowance for 2-day working hours per two hours per two hours per two hours per one day. The Defendant paid wages to the Plaintiffs in accordance with the above wage agreement.
2. The plaintiff's assertion and judgment shall be the P.M. team worker.
