1. The plaintiff's appeal is dismissed.
2. The costs of appeal shall be borne by the Plaintiff, including the part arising from the supplementary participation.
Reasons
1. The reasoning of the court of first instance’s explanation concerning this case is as follows. Except for the addition of relevant Acts and subordinate statutes listed in the annexed Form of this judgment to the annexed Form of this judgment, the court of first instance cited part of the judgment as to this case as stated in the reasoning of the judgment of the first instance. Thus, this is acceptable in accordance with Article 8(2) of the Administrative Litigation Act and Article 420 of the Civil Procedure Act.
(Other contents asserted by the Plaintiff in this Court are not significantly different from the contents alleged by the Plaintiff in the first instance trial, and even if all of the evidence presented in the first instance trial and in this court were examined, the first instance judgment rejecting the Plaintiff’s assertion is justifiable). From 8th to 20th is as follows.
[4) According to Article 11(2) of the Enforcement Decree of the Information Disclosure Act, the Information Disclosure Council shall deliberate on the objection raised under Articles 18 and 21(2) of the Information Disclosure Act.
Article 18(1) of the Information Disclosure Act provides that “Where the applicant is dissatisfied with the decision on non-disclosure or partial disclosure of information by a public institution related to the disclosure of information or where no decision on disclosure of information is made by 20 days after the request for the disclosure of information, the applicant may file an objection in writing with the relevant public institution within 30 days after the date on which 20 days have elapsed since the public institution received notice of the decision on whether to disclose information or after the request for disclosure of information from the public institution.” Article 21(2) of the same Act provides that “Where the information requested for disclosure is related to a third party, the public institution may file an objection against the said decision
In other words, an objection under Article 18 of the Information Disclosure Act is an objection to the public institution's request for disclosure of non-disclosure decision or partial disclosure decision, and the objection under Article 21 of the same Act is a public institution.
