공소사실의 요지 피고인은 2010.말경부터 2011. 7.경까지 라틴댄스 공연팀인 “B 댄스팀”의 총무로 있었던 사람으로, B 댄스팀의 이름으로 교육청 주관 및 문화재단 공연을 유치하게 되자, 그 공연비 중 일부를 횡령하기로 마음먹었다.

1. Occupational embezzlement;

A. On February 2, 2011, the Defendant, at the Seocho-gu Busan District Office of Education, decided to set up a B dancing Team for a performance supervised by the Office of Education at the Office of Education in Busan, Busan, the Defendant received KRW 12 million from the Office of Education (the unit price of KRW 800,000 per council, the total amount of KRW 15,000) but embezzled 5,50,000 for members. The remainder of KRW 6,500,000 for the said B dancing Team, while carrying out his/her duties, he/she arbitrarily consumed and embezzled it for personal purposes around that time.

B. The Defendant: (a) on March 201, 201, was a Lieutenant.

The “E” performance under the supervision of the Cultural Foundation in the office, such as Paragraph 2, is to be held by the dance team. On May 24, 2011, even if the Defendant received KRW 3 million with the performance preference money, the members will share the performance money after the five-time performance ends and receive the performance payment after the performance was completed, and the said performance was embezzled by using the performance for personal purposes for the said B dance team at the time of its business storage.

2. Forgery of private signature, and the use of a false investigation or signature;

A. On March 3, 2011, the Defendant, at the Defendant’s residence located in Suwon-gu, Busan, 4, 1003, prepared “production/contribution” in the documents for filing an application for a performance governed by the Cultural Foundation under the name of the B dancing Team, and forged G, I and H’s signature by arbitrarily signing the signature of “G”, “I”, and “H” in the column of the consent to the contribution, although not having obtained the consent of G, H and I, a member of the dance team.

B. On March 3, 2012, the Defendant is in charge of the filing of a written application with the above forged signature in the Busan Cultural Foundation located in Busan Metropolitan City, Busan Metropolitan City.
