A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
【The Defendant was sentenced to a summary order of a fine of two million won for a crime of violating road traffic laws at the Ulsan District Court on March 14, 2014, and on January 23, 2015, the Defendant was sentenced to a suspended sentence of two years for eight months for a crime of violating road traffic laws at the Ulsan District Court.
[Criminal Facts]
1. No one who violates the Traffic Act and the Guarantee of Compensation for Damages of Motor Vehicles shall operate any motor vehicle on a road which is not covered by mandatory insurance;
Nevertheless, around 00:20 on August 28, 2016, the Defendant driven a 528 vehicle with alcohol content 0.17% under mandatory insurance in a section of approximately 500 meters from the front of the department store to the front of the night road located in 667 in the same Gu, from the front of the department store to the night road located in 667 in the same Gu.
As a result, the Defendant, who had the power of violating the Road Traffic Act (drinking driving) more than twice, driven the said vehicle without mandatory insurance under the influence of alcohol.
2. A motor vehicle dealer who violates the Motor Vehicle Management Act shall have his/her front registration number plate of a motor vehicle for sale kept by the relevant motor vehicle trade association or the head of the relevant Si/Gun/Gu;
No person shall unlawfully use a motor vehicle registration number plate.
Nevertheless, the Defendant, at the time and place specified in Paragraph 1, failed to keep the front registration number plate of the said car, which is registered as a motor vehicle for the sale and purchase of a motor vehicle owned by a motor vehicle trading company, which is a motor vehicle trading company, at the same time and place, and without having the motor vehicle trading business association or the head of a Si/Gun/Gu keep it.
Accordingly, the Defendant used the car registration number plate unlawfully.
