1. The defendant shall within the scope of the property inherited from the deceased B, and KRW 75,391,189 and 30,000 among them.

On May 29, 2012, Korea Savings Bank (the Plaintiff was appointed as a trustee in bankruptcy after being declared bankrupt on July 1, 2014; hereinafter “Plaintiff”) determined and lent KRW 30,00,000 to the net B on May 29, 2012 as the rate of 27.9% per annum, the due date for payment, and May 15, 2013. As of October 17, 2016, the above principal and interest amount were KRW 75,391,189 (i.e., principal amount of KRW 30,000,000 and delay damages amount of KRW 45,39,189). Of the deceased’s inheritors, the Defendant filed an application for approval of inheritance with the Incheon District Court (the Incheon District Court 2013Nu602, Jun. 16, 2013) or filed an application for approval of inheritance between the heirs and the heir No. 315,2013.25

According to the above facts, the defendant is obligated to pay to the plaintiff 75,391,189 won of the principal and interest of the loan and 30,000,000 won of the principal and interest of the loan within the scope of the property inherited from the deceased B, as calculated by the overdue interest rate of 27.9% per annum from October 18, 2016 to the date of full payment.

The plaintiff's claim of this case is justified and accepted.
