1. The Defendant’s KRW 26,34,00 for the Plaintiff and KRW 5% per annum from December 16, 2015 to November 11, 2016.
Reasons
1. Facts of recognition;
A. C Forest land 69,719 square meters (hereinafter “C”) in Namyang-si was land owned by D and E (D 45719/69719, E2400/69719 equity), and thereafter divided and registered as follows.

B. On November 5, 2013, D and E (U) entered into a sales contract with D on the purchase price of KRW 3.688,77 million for the purchase price of KRW 15,371 square meters of D equity 45719/69/69719 between D, W and X. 2) and D on May 21, 2014.
3) On June 12, 2014, U.D’s agent sent to W,V, and X a certificate of the purport that the contract will be rescinded in the event that the balance under the sales contract for C entered into between W,V, and X was not paid, and the contract was rescinded as the remainder was not paid thereafter. 4) On June 29, 2014, the Plaintiff entered into a sales contract with D as to the purchase price for the land of this case as KRW 3,81,60,000 with respect to the purchase price for the land of this case (hereinafter “land of this case”).
After that, on June 9, 2015, each transfer registration of ownership in the name of the plaintiff was completed with respect to the above land.
C. On December 17, 2012, D and E entered into a contract for construction works with AB operated by the Defendant on November 27, 2013 for the purpose of site creation of a sanatorium for older persons with respect to the area creation of a sanatorium for older persons (land form and quality alteration) with respect to the area of a sanatorium for older persons (land form and quality alteration).
Then, W entered into a contract for construction work with AB on January 7, 2014 regarding C forest unit civil engineering work.
