A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On April 25, 2014, the Defendant was sentenced to imprisonment with prison labor for six months at the Seoul Central District Court for fraud, and the said judgment became final and conclusive on May 3, 2014.

【2014고단8238】 피고인과 C는 인기가수 D(본명 E)이나 D의 매니저, 기획사 등을 전혀 알지 못하여 피해자 F으로부터 돈을 받더라도 D을 행사에 섭외해 줄 의사나 능력이 없음에도 불구하고, 피고인은 2012. 3. 중순경 익산시 G에 있는 ‘H’에서 피해자에게 “2012. 7. 7. 예정된 교회행사에 가수 D을 섭외해 줄 테니 행사비를 먼저 입금하라”라고 거짓말을 하면서 C를 D의 매니저인 것처럼 소개해 주고, 그 무렵 C는 피해자에게 전화를 걸어 D의 매니저인 것처럼 행세하면서 "스케쥴을 보니 2012. 7. 7. D이 행사참석이 가능하니 행사비를 먼저 입금시켜 달라'라고 거짓말을 하였다.

On March 31, 2012, the Defendant and C received 2.2 million won from the victim to the new bank account in the name of C as an event expense.

Accordingly, the defendant was given property by deceiving the victim in collusion with C.

1. Around November 15, 2012, the Defendant made a false statement to the Victim K, “If he/she is engaged in an entertainment-related business and lends KRW 4 million to the victim K, he/she would pay the principal and interest KRW 1 million after the month.”

However, even if the defendant borrowed money from the victim because there is no particular income or property, he did not have the intent or ability to repay the principal and interest as agreed.

As above, the Defendant, by deceiving the victim, received KRW 4 million from the victim to the private village or L company bank account in his/her name on November 19, 2012, as well as from that time to July 6, 2013, under the name of L’s account and Defendant’s name, totaling KRW 327 million over seven times in total, as shown in the list of crimes in the attached list of crimes, from that time to July 6, 2013.
