Defendant
A Imprisonment with prison labor for one year, for ten months, for each of the defendants C and D, shall be punished by imprisonment for each of eight months.
Reasons
Punishment of the crime
1. No person who violates the Acts of housing shall transfer, acquire, or mediate any deed or status for the purpose of acquiring or having others acquire the supply of housing constructed and supplied pursuant to the Acts of housing;
A. When Defendant A came to know that there was a high probability of winning a house offer compared to the general supply of multi-child households, Defendant A, through the head of the passbook B, C, and D, purchased related documents, such as the head of the passbook, from those who meet the above priority eligibility requirements, and purchased the documents, such as the head of the passbook, and sold them under the name of the subscriber of the head of the passbook, thereby acquiring the proceeds from resale.
On July 4, 2015, the Defendant: (a) received data from H eligible for the priority order for special supply of multi-child households through B, C, and D from G food stores located in Changwon, to subscribe to housing in the name of H, such as a comprehensive passbook, resident registration certificate, and family relation certificate; (b) paid KRW 1 million in compensation to H through B, etc.; and (c) acquired a certificate or status that can be supplied with housing over 17 times in total from May 4, 2015 to December 2015, as shown in attached Table 1 of the daily list of crimes.
B. Defendant B, Defendant C, and Defendant D conspired with each other on July 2015, the Defendants: (a) received data that could be offered in the name of H, such as a comprehensive passbook, resident registration certificate, and family relation certificate, from G food stores located in Changwon-si on the first day of July 2015, and transferred them to A; and (b) received KRW 2 million in return, and delivered one million out of the said money to H from the end of June 2015 to the first day of December 2015; and (c) mediated the transfer and acquisition of a certificate or status that could receive a house from A, I, and J over 27 times in total, as shown in the list of crimes in the attached Table 2.
