A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
On January 26, 2018, the Defendant was sentenced to one year of imprisonment for fraud, etc. at the Seoul Central District Court on January 26, 2018, and the execution of the said sentence was terminated on October 5, 2018.
around 00:12 on April 12, 2019, the Defendant: (a) around 200:12, the victim C in Gangnam-gu Seoul Metropolitan Government was engaged in an act as if he/she would pay the normal drinking value at the “D” entertainment tavern work as an employee; and (b) ordered the victim to provide alcohol, food, etc.
However, the defendant did not have any intention or ability to pay the price normally even if he received drinking, food, etc. from the victim because of the lack of money.
The Defendant, by deceiving the victim as above, received 2 soldiers worth KRW 600,000 in total market value of the same day from the victim, and received 1,210,000 from the victim, and received entertainment services equivalent to KRW 1,360,00 in total, including 1,360,000, and 100,000, and acquired economic benefits equivalent to 1,360,000,000 from the time of being provided with entertainment services, and from October 17, 2019, by deceiving the victims on four occasions, as described in the attached list of crimes, respectively, received property or acquired economic benefits equivalent to KRW 11,570,00 in total.
around 20:00 on October 14, 2019, the Defendant, “2019 Highest 77444,” committed an act as if he/she would pay the normal drinking value in the “G” entertainment tavern operated by the victim F of the victim F in Gangnam-gu Seoul Metropolitan Government E branch, Seoul, and ordered H, an employee, to provide an order for alcohol, alcohol, etc.
However, the defendant did not have any intention or ability to pay the price normally even if he was provided with alcoholic beverage, alcoholic beverage, etc. due to the lack of money.
The Defendant, as above, by deceiving H, received alcohol and algorition equivalent to the total market value of KRW 3,560,000, thereby deceiving H.
