The sentence of sentence against the defendant shall be suspended.

Punishment of the crime

The defendant is currently a divorce suit between the victim B and the married couple.

1. 재물손괴 피고인은 2013. 6. 25. 12:00경 자신과 남편인 피해자 B(45세)와 공동 명의로 되어 있는 서울 노원구 C아파트 27동 1005호를 방문한 피해자와 이혼소송 등과 관련하여 서로 대화를 하던 중 피해자에게 "씹쌔기야, 나가버려라, 집에 왜 들어왔느냐"라고 하였고, 이에 피해자가 집에서 나가기를 거부하자 화가 난 피고인은 망치로 거실에 있는 피해자 소유인 시가미상 어항 2개(가로 60cm, 세로 45cm), 어항 2개(가로 45cm. 세로 45cm)등 총 어항 4개를 망치로 깨뜨리는 방법으로 손괴하였다.

가. 피고인은 2013. 6. 28. 12:13경 서울 도봉구 도봉동 626에 있는 서울북부지방법원 앞 노상에서 피해자와 협의이혼문제로 인하여 대화를 하던 중 피해자가 어디론가 사라지자 핸드폰 문자를 사용하여 피해자의 핸드폰으로 "이 개쌔끼야, 니 이럴줄 알았어, 거짓말로 한 세상 살아본 놈이라, 오늘 내가 끝장낼꺼야, 니 애비집 찾아가서라고 끝장 볼거야, 도둑놈아, 담배사러간다고 하고 도망가냐, 돈에 눈먼 새끼, 지식도 몰라라 하는 새끼, 넌 내가 꼭 원수 갚을꺼야"라고 하는 등 문자를 발송하였다.

B.
