A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Fraud;

A. On March 13, 2012, the Defendant made a false statement to the victim E (the 41-year old-old 2003 old-old d d d d d d d d d d d d d d d d d d d d d f d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d d

However, the Defendant was unable to pay KRW 150,000,000 borrowed from G because it was difficult to operate the F with the trade name from around 2006, and the Defendant was transferred to another person the factory around July 201, because it was difficult to pay KRW 150,000,000 borrowed from G. The Defendant did not have any intent or ability to pay money from others even if it borrowed money from others because there was no special property even after the total amount of KRW 200,000,

Nevertheless, the Defendant received money KRW 17 million from the victim to the post office account (Account Number H) in the name of the Defendant on the same day.

Therefore, the defendant deceivings the victim to take money by deceiving the victim.

B. On April 17, 2012, the Defendant made a false statement to the victim E at the F Office in Jung-gu Incheon, Jung-gu, Incheon, stating that “A dump vehicles purchased are not yet sold and are placed in the accident, and there is a lot of profit if the Defendant purchased and repaired the vehicle. However, the Defendant would make a profit by finding out the vehicle’s purchase cost of KRW 10,000,000 and loan the money.”

However, in fact, the Defendant was unable to pay KRW 150,000,000 borrowed from G because it was difficult to operate a maintenance factory with F from around 2006 due to difficulties in operating the factory, and the Defendant transferred the factory to another person on July 201, and even thereafter, there was no special property when the total amount of KRW 200,000 is accumulated.
