피고인은 2011. 8. 9. 01:10경 대구 수성구 C 앞 노상에서 차량경보음 소리를 듣고 밖으로 나온 피해자 D(62세)으로부터 “시간이 몇 시인데 경적을 울립니까 잠 좀 잡시다”라는 말을 듣게 되자 화가 나 피해자의 멱살을 잡아 흔들며 주먹으로 피해자의 얼굴을 때리고 넘어져 있는 피해자를 발로 걷어찼다.
