A defendant shall be punished by imprisonment for one year.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. A person who violates the Act on Special Cases concerning the Settlement of Traffic Accidents (Death or Injury) is a person engaged in the operation of an unregistered soft machine which is a construction machine;

2. Violation of the Construction Machinery Management Act;

(a) No person who uses or operates unregistered construction machinery shall use or operate such construction machinery not registered;
