A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On April 25, 2020, the Defendant accepted the Internet search on the ground of “documents transmission/out-of-the-counter service/confluence”, with the proposal of “on the part of the party’s name, who received the phone, will receive money at a place known to him/her, and will pay KRW 200,000 in cash on the day.”

On April 10, 2020, the above false statement was made to the victim B stating that "the victim who sent the message "the new world department store was settled," and reported it to him, "the victim will be ordered to receive the report from C Center unless he makes the settlement," and continuously, around April 13, 2020, the victim called the victim to "the victim will receive the report from C Center" and "the victim will not receive the money from the home shopping mall and deliver the money to the designated person in accordance with the direction of the deceased's name by making phone calls to the victim, and the victim was accused of the victim because he did not receive the money from the home shopping mall, and the amount of the damage is about one billion won, and the cooperation should be given to the persons related to the bank and the card company, and the persons related to the lending industry are under investigation, and the victim tried to withdraw the 15 million won and deliver the money to the designated person in accordance with the direction of the deceased's name."

On April 27, 2020, the Defendant received the order from the above person who was named in the name of the victim of the crime of scambling and attempted to commit the crime of scambling from the victim on the road located in Yongsan-dong, Yongsan-gu, Seoul, Yongsan-gu, Seoul. However, the Defendant failed to arrest the police officer dispatched by the victim’s report who was suspected of committing the crime of scambing and attempted to commit the crime of scaming by taking 15 million won from the victim in front of the scambling community service center.

Accordingly, the defendant is guilty of the above-mentioned person.
