1. The Defendant’s Gwangju High Court ( Jeju) on November 8, 2017, Jeju District Court Decision 2017Na10444 decided November 8, 2017.

Reasons

1. Facts of recognition;

A. On November 6, 2014, the Defendant filed a lawsuit for delivery of movables against the Plaintiffs and D, and partly won the lawsuit ( Jeju District Court 2014Gahap6394), and at the appellate trial of the instant case (Seoul High Court 2017Na10444) (the Jeju High Court 2017Na1044)] on November 9, 2017, and the judgment of the following order was finalized on November 24, 2017.

(hereinafter “Related Judgment”). 1. The Plaintiffs and D jointly pay to the Defendant the amount calculated at the rate of KRW 14,263,64 per annum until July 26, 2015, and KRW 14,263,664 per annum from February 5, 2015 to the date of completion of the use of movables listed in the separate sheet or the date of loss of the Defendant’s ownership, and KRW 6,148,162 per annum to the Defendant.

2. The Plaintiffs shall not interfere with the Defendant’s collection or removal of movable property listed in the separate sheet.

B. On August 9, 2017, the Plaintiffs deposited KRW 41,94,100, the sum of KRW 6,148,162, and KRW 14,664, per annum from February 5, 2015 to August 9, 2017, calculated at the rate of KRW 14,263,664, and KRW 41,94,100, and KRW 1,08,300, total of the costs incurred from the movable auction case (No. 2017, No. 484, the Jeju District Court) applied by the Defendant in accordance with the relevant judgment, from August 9, 2017 to KRW 42,952,40 (=41,94,100,100,308,300).

On January 11, 2018, the Plaintiffs deposited KRW 7,131,832 in the amount calculated by the ratio of KRW 14,263,64 per annum from August 10, 2017 to February 9, 2018 (i.e., KRW 14,263,664 x 6/12) and KRW 77,880 in the said movable auction case (i.e., KRW 7,209,712 in total (i.e., KRW 7,131,832 won) and KRW 77,880 in the said movable auction case.

On March 8, 2018, the Plaintiffs deposited KRW 2,377,277,277, the amount calculated at the rate of KRW 14,263,64 per annum from February 10, 2018 to April 9, 2018, among the obligations under the relevant order, with the Defendant as the principal deposit, (i.e., KRW 14,263,664 x below the original unit).
