1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. Transaction 1 between the Plaintiff and A) Gunsan-si with the trade name “B” from Gunsan-si (hereinafter “B”).
A) A, around May 2005, operated a contract between the Plaintiff and the Plaintiff, upon importing the Chinese-produced foreign language, A purchased it from the Plaintiff and entered into a transaction agreement with the Plaintiff to sell it at a nationwide retail store, and made a transaction with the Plaintiff starting from that time. B) On February 2009, A proposed that the director of the Plaintiff’s Youngnam Business Department C Team D, who had been in charge of the said transaction, purchased the domestic-produced foreign language from the Plaintiff Youngnam Business Division Co., Ltd., Ltd. (hereinafter “Korea Eta”), and requested D to sell the domestic foreign language to the Plaintiff by selling it to the Plaintiff. However, the Plaintiff, a large enterprise, could not supply it to the Plaintiff because it concerns the Plaintiff’s entry into the distribution market.
3) Accordingly, A and the Plaintiff ( substantially D dealt with the Plaintiff’s work related to A).
A) A around February 2009, received funds from the Plaintiff for the purchase of locks from the Plaintiff and purchased locks in the name of E in which A substantially operates, and E sells this to the Plaintiff, the Plaintiff once sold it to B, and B entered into a verbal contract with B to trade it by way of selling it to retail stores nationwide (hereinafter “instant 1 supply contract”).
4) Examining the process of the above transaction in detail as follows.
In other words, if A send a written order to the Plaintiff under the name of B, the Plaintiff shall request E to send a written estimate, and accordingly, if E submits a written estimate to the Plaintiff, the Plaintiff shall approve the tax invoice issued by E through the internal process of preparing and approving a written purchase statement, such as the written estimate, and then the purchase fund (the purchase price is the document purchase price, since it is the document purchase price).
