1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. The plaintiff's assertion that the plaintiff, at the defendant's request, lent to the defendant a sum of KRW 27,300,000 from February 28, 1997 to June 16, 2003, a sum of KRW 22,730,000 from February 28, 1997 to June 16, 200. The defendant agreed to pay interest equivalent to the interest rate on the above loan, but did not pay the above KRW 227,30,00 and interest after October 2004. Thus, the defendant is obligated to pay the above loan amounting to KRW 22,730,00 and delay damages.
2. (1) Determination (1) No dispute exists between the parties, or according to Gap evidence Nos. 1 through 5 (including the number number, respectively), the fact that the plaintiff remitted a total of KRW 163,472,530 to C, D, E, etc., who were the defendant's and the defendant's wife, during the period from February 28, 1997 to June 13, 2003, as indicated below.
