A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Fraud against the victim C;

A. On July 15, 2008, at the early 15:00, the Defendant stated that “A victim C, via D, who is the Defendant’s seat, “I would make a repayment immediately if I would lend 3 million won to the Defendant’s seat rapidly.”

However, even if the defendant borrowed money from the victim, he thought that he would use it for the purchase cost, such as the defendant's bank, and there was no intention or ability to repay the above money to the victim.

Nevertheless, the defendant deceivings the victim as above and acquired 3 million won from the victim.

B. On September 1, 2008, around 02:00, the Defendant made a false statement to the Fjum operated by the victim in Busan, stating that “If the Eastern is in need of hospital expenses after undergoing the diagnosis of liver cancer, if it is lent KRW 2 million, it would be repaid until October 1, 2008.”

However, even if the defendant borrowed money from the victim, he was thought to use it as an individual repayment, etc., and there was no intention or ability to repay the above money to the victim.

Nevertheless, the defendant deceivings the victim as above and acquired 2 million won from the victim.

2. Fraud against victim G;

A. On July 15, 2008, the Defendant made a false statement that “The Defendant would pay the said money to the victim while working in the I entertainment tavern under the pretext of a prior payment at the I entertainment tavern in Busan.”

However, even if the defendant received the money from the victim as a prepaid payment, he did not have the intent or ability to pay the above money from the victim's main point.

Nevertheless, the defendant deceivings the victim as such and acquired 8 million won from the victim.

B. On July 16, 2008, the Defendant will work on the part of the victim within the head of the Centre department located in Busan Shipping Daegu.
