가. 원고는 2012. 8. 27. 피고에게 별지 목록 기재 부동산의 경량철골조립식 아연강판지붕 단층 근린생활시설 397.50㎡ 중 별지 도면 표시 ㉠, ㉡, ㉢, ㉣, ㉠의 각 점을 차례로 연결한 선내 부분 99.174㎡(이하 이 사건 부동산이라고 한다)를 임차보증금 3,000만 원, 월세 80만 원, 임대차 기간 2012. 9. 21.부터 2014. 9. 20.까지로 정하여 임대하였다.

2. The assertion and judgment

A. According to the above facts, inasmuch as the term of the instant real estate lease expires, the Defendant is obligated to deliver the instant real estate to the Plaintiff.

B. The Defendant asserts that the five-year lease period should be guaranteed under the Commercial Building Lease Protection Act regarding the instant real estate.

The lessee of the Dog- pursuant to the contract may request the lessor to renew the contract within the extent not exceeding five years of the entire lease. However, the lessor may refuse to renew the contract if it is necessary to recover possession of the building for the purpose of removing or rebuilding the whole or most of the buildings for the purpose.

[Article 10(1)7 and (2) of the Commercial Building Lease Protection Act (amended by Act No. 11873, Jun. 7, 2013) / [Article 10(1)7 and 10(2) of the Commercial Building Lease Protection Act). According to the aforementioned evidence, the Plaintiff’s possession of the instant real estate in order to reconstruct and restore the said real estate is recognized.

According to this, the plaintiff, a lessor, can refuse the request for renewal of the contract. Therefore, the defendant's assertion that the lease term is five years is groundless.
