Reasons
1. The reasoning of the court of the first instance’s explanation concerning this case is as follows, with regard to the subsequent assertion by the parties, the reasoning of the court of the first instance is as stated in the reasoning of the first instance judgment, except for adding a part of the grounds of the first instance judgment or adding a part of the grounds, as set forth in the following paragraph (2). In light of the following circumstances, the Defendant’s above e-mail’s above e-mail stating that “the Plaintiff removed the AD book of the local government A with a view to raising money, W players driven away from Russia, and purchased a new official car with the money,” and thus, the Plaintiff’s e-mail was likely to violate the social value and evaluation of Plaintiff B’s e-mail, and thus, the illegality of the e-mail should be avoided (However, in light of the following circumstances, the above e-mail is deemed to have public interest and reasonableness, and the illegality of the e-mail is deemed to be avoided (i.e., “the e-mail of sports players is close to B’s monthly salary, rather than one idea of the head of the local government B,” “the main offenders who promote the national system and market economy at the e-mail, etc., were attacked at any time.” The e-mail expression, such as the Plaintiff’s refusal to reject the Plaintiff’s e-mail’s e-mail or the Defendant’s subjective judgment.
(1) In determining whether a tort caused by defamation is constituted, the criteria for determining whether a victim who is damaged by the relevant expression is a public figure or a private figure, or whether such expression concerns a public concern or a purely private matter should be different depending on whether it pertains to a matter of interest, and the criteria for determining whether it falls under a pure private sphere.
