1. The plaintiff's appeal is dismissed.

The purport of the claim and appeal is the purport of the appeal.

1. Basic facts

A. The Plaintiff is a person who runs a construction business, such as building assembly construction and roof board construction business, under the trade name of “C,” and the Defendant is a corporation with the aim of building and engineering work.

B. The Plaintiff and the Defendant concluded each of the instant construction contracts, including two or more subcontracts of construction works (hereinafter referred to as “each of the instant contracts,” and the following 1) subcontracts of construction works, respectively (hereinafter referred to as “instant First Contract,” and 2).

1) Subcontract of construction works on a panel among D factory construction works (a modified contract)

1. The project owner: The name of the main contract construction corporation: D factory construction corporation in E;

2. The name of subcontracted construction works: each panel;

3. Construction site: Gyeonggi-do Gunpo-si E.

4. Construction period: Amount of value-added tax of 181,50,000 won: 16,500,000 won for value-added tax of 165,00 won, on September 5, 2013, and on October 5, 2013, completion: 16,50,000 won.

6. Payment of the price;

(a) September 10, 200,000 won in advance; and

B. (1) Method of payment: (3) Payment shall be made at the end of each month after the end of each month on a monthly basis after the end of each month, within 10 days from the date of receipt of the object of cash settlement; (1) Payment shall be made at the end of the following month;

4. Construction period: Value-added tax of 95,00,000 won, for value-added tax of 104,50,000 won, for the supply period on April 11, 2014, and April 30, 201, as completed on April 30, 2014: 9,50,000 won.

6. Payment of the price;

(a) Contract deposit: 66,000,000 won; and

B. The intermediate payment (1) is the balance approved on the 10th day of the following month after the end of the month: it is in accordance with the fairness.
