1. The defendant

(a) Of the first floor of the building listed in the separate sheet, each point of the attached sheet Nos. 1, 2, 3, 4, and 1.

Reasons

1. Facts of recognition;

A. On July 10, 2017, the Plaintiff was transferred the ownership of the building indicated in the separate sheet from B, and the Defendant is the lessee of the portion 42.9 square meters in the part (A) of the attached sheet among the first floor of the above building (hereinafter referred to as “second shop”) and the part (B) 42.9 square meters in the ship (hereinafter referred to as “three units”) connected with each point of 2,5,6,3, and 2 of the aforementioned drawings, which are successively connected with each point of 1,2,3,4, and 1.

B. On September 30, 2015, between B and B, the former owner of the instant building, the Defendant concluded a lease agreement with regard to the two stores by setting the deposit amount of KRW 24,00,000, monthly rent of KRW 1,000,00 (including additional tax) and September 29, 2017 from September 30, 2015 to September 29, 2017. On June 13, 2016, the Defendant concluded a lease agreement by setting the deposit amount of KRW 24,00,000, monthly rent of KRW 1,050,000 (Additional tax), and the lease period from June 12, 2016 to June 11, 2018.

On July 10, 2017, the Plaintiff purchased the instant building from B and completed the registration of ownership transfer, thereby succeeding to the lessor’s status.

The Plaintiff and the Defendant continued to use the said 2 shop until the expiration of the lease term of the said 3 shop, and agreed to reduce the monthly rent of the said 2 shop until the expiration of the lease term of the said 3 shop to 300,000 won. On October 1, 2017, the Defendant drafted a letter of confirmation of the expiration of the lease term and the temporary use of the said 2 shop, stating that “I confirm that I will deliver the said 3th floor lease term to the lessor without any condition, along with the expiration of the lease term of the said 3th floor.”

E. Each of the instant lease agreements expired on June 1, 2018, which is the expiration date of the lease term of 3 head offices, but the Defendant is the building of this case.
