1. To establish and operate welfare facilities for persons with disabilities in violation of the Act on Welfare of Persons with Disabilities, a report shall be filed with the head of the competent Si/Gun/Gu;
Nevertheless, Defendant A, without reporting to the competent authority from around April 2, 2015 to around April 2, 2018, installed a welfare facility for the disabled under the name of “E” after being equipped with facilities necessary for the accommodation of disabled persons, such as the housing located in Yongsan-gu, U.S. and the storage and office of the recycling product classification workplace and office located in U.S. Dong-gu, U.S., Manyang-si, and the foregoing facility was operated by accepting six persons, such as the 1st disabled F, the 2nd disabled, the 2nd disabled, the 3rd disabled, the 3rd disabled, the 3rd disabled, the 1st disabled, and the 1st disabled K of the intellectual disability.

While operating the “E” as above, Defendant A was in charge of the duties to pay social security benefits, such as basic living benefits and disability allowances, paid to the disabled persons by Goyang-si while receiving and managing social security benefits from the disabled persons concerned. A.
The Defendant: (a) while keeping basic living benefits and disability allowances paid to the victim G’s account for receiving social security benefits, which is a disabled person belonging to the foregoing “E,” in the course of business on March 25, 2016 for the victim; (b) arbitrarily using KRW 33,800 as a siren expense unrelated to the victim G; and (c) from that to March 22, 2018, he/she embezzled KRW 13,16,20,22, 22, 23, 26, 27, 28, 30, 32, 33, 36 (28,509), 37, 40, 42, 43 (10 won among them), 45, 51, 53, 538, 501 through 50; and (d) arbitrarily using another person’s mobile phone fee.
B. The Defendant, around January 20, 2015, is the beneficiary account of social security benefits of the victim H, a disabled person affiliated with the said “E” from Goyang-si.
