Reasons
1. Basic facts
A. AF completed the registration of ownership transfer on January 11, 1999 with respect to the land indicated in the attached Table 2 of Jongno-gu Seoul Metropolitan Government AG large AG large 624.2 square meters and AH large 53.1 square meters (hereinafter “instant land”). On October 25, 1999, the Seoul Central District Court completed the registration of ownership transfer on the basis of No. 1610,000,000 won for the National Bank of Korea (hereinafter “National Bank”), the maximum debt amount of KRW 3,120,000,000,000,000 won, and the debtor AI Co., Ltd (AF purchased the instant land; hereinafter “AI”), a neighboring mortgage registration (hereinafter “mortgage 1 mortgage”) and superficies creation registration on the same date as the debtor-mortgage 20,000,000 won (hereinafter “AF mortgage”) and the maximum debt amount prior to AF mortgage creation on June 26, 2007.”
B. As to the land in this case, ① AK received a decision of voluntary commencement of auction from the Seoul District Court AM on December 6, 2002, and the registration of the entry was completed on December 12, 2002, ② AL received a decision of voluntary commencement of auction from the Seoul District CourtN on April 18, 2003, and the entry registration was completed on April 24, 2003, and ③ a national bank received a decision of voluntary commencement of auction from the Seoul District Court AO on December 18, 2003, and the entry registration was completed on December 23, 2003.
(Then, the registration of each of the above entries and the registration of the establishment of the establishment of the creation of the first to the third party on December 20, 207 were cancelled on January 3, 2008, respectively.
AI leases the instant land from AF on September 18, 199 to September 18, 2001 by setting the term of lease from September 18, 199 to KRW 100 million, and between AF on May 31, 2001.
