On December 18, 2014, A was sentenced to a suspended sentence of six months for a violation of the Act on the Punishment, etc. of Sexual Crimes (obscenity using communications media) by the Incheon District Court on December 18, 201, and the judgment became final and conclusive on December 27, 2014.

Defendant A awarded KRW 201 and KRW 202 of the second floor of the 2nd floor of the 1st office in Yeongdeungpo-gu Seoul, Yeongdeungpo-gu, Seoul (hereinafter “the instant PO letter”) around March 201, Defendant A, who was awarded a bid in the name of the J., and Defendant B, under the direction of A, performed construction works relating to boiler in the instant PO letter.

A은 2011년 4~5 월경 K, L, M, N 등에게 이 사건 사우나 내 이발, 세신, 스낵 매점 등 운영권을 주기로 약정하고 임대 보증금 등 명목으로 합계 약 4억 2,000만 원을 받았으나 자금난으로 2011년 11 월경부터 약 2개월 간 운영한 후 이 사건 사우나를 폐점하여 2012. 4. 19. 경 위 L이 서울 남부지방법원 O로 이 사건 사우나에 대하여 임의 경매를 신청하였고, 2012. 4. 23. 임의 경매 개시 결정이 되었다.

A and B facts are as follows: (a) Defendant A reported a lien in Defendant B’s name as if there were unpaid construction costs that amount to KRW 320 million, even though the unpaid construction costs that Defendant A had to pay to Defendant B are less than KRW 20 million; and (b) the amount equivalent to the unpaid construction costs if another person is awarded a successful bid; and (c) the Defendants conspired to receive a successful bid if the successful bid is lower due to continuous failed bid.

A and B, around December 28, 2012, prepared relevant documents, such as the Defendants’ false construction contract and written confirmation of payment details, Defendant B’s resident registration, Defendant A’s resident registration certificate, and Defendant A’s seal impression certification, etc., and on January 2, 2013, the aforementioned voluntary auction procedure was in progress at the six-class office of the Seoul Southern District Court of Seoul, Yangcheon-gu, Seoul, Seoul, Seoul, 196, on the ground of the instant letter or the instant claim for the construction payment due to the automatic control and machinery construction contract.
