A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Violation of the Act on the Control of Narcotics;
A. On October 4, 2018, the Defendant asked B to receive marijuana, and around 04:00 on October 6, 2018, the Defendant received marijuana by delivery of approximately 3g of marijuana contained in vinyl B, in front of the entertainment drinking bars located in Jung-gu Seoul Metropolitan Government (hereinafter “D”).
B. On October 6, 2018, between 05:00 and 06:00, the Defendant: (a) put marijuana in the front air of the apartment apartment of Yangcheon-gu Seoul, Yangcheon-gu, in the cubing clock; (b) made the marijuana tobacco; and (c) made the marijuana tobacco by heating it into a rash, thereby smoking it.
C. On October 20, 2018, around 04:29, the Defendant received approximately 2g g of marijuana contained in vinyl, upon request from B before “D” entertainment taverns located in Jung-gu Seoul Metropolitan Government, to deliver it to F, and upon request, received it.
2. Around March 2019, the Defendant violated the Act on the Control of Narcotics, etc. (flavoring) received a request from F to “exploscers upon request from B”.
At that time, the Defendant: (a) purchased and asked B to purchase MMA 3 shares; and (b) sent F to B the G bank account in March 15, 2019 the amount of KRW 6,40,000 to B under the MMA price; and (c) B sent a message to ask whether the seller of narcotics, etc., who traded, can purchase MMA using HH ID, but was arrested by the said seller, was discovered to the police investigator.
B, around 19:35 on March 19, 2019, transferred KRW 500,000 to the account known by the police investigator. On March 20, 2019, around 19:20, it was not possible to find out the MMA5 in the I parking lot in Seoul Special Metropolitan City, Gwanak-gu, but to arrest police investigators who were unclaimed at the site.
Accordingly, the Defendant attempted to arrange the MMA trading between F and the seller of narcotics, etc.
