A defendant shall be punished by imprisonment for not less than eight months.
The application for compensation of this case is dismissed.
Reasons
Punishment of the crime
1. Larceny;
A. A. On July 1, 2015, around 02:00 on July 1, 2015, the Defendant: (a) entered into the E-Sae or Southern Sheet in Geumcheon-gu Seoul, Geumcheon-gu, Seoul; (b) used the gaps of the victim F, an employee, to take advantage of the gaps in which the victim F, was self-employed; and (c) stolen Samsung Tallon, which is equivalent to KRW 400,000,00 in the market value of the victim in his book.
B. On July 13, 2015, around 03:29 on July 13, 2015, the Defendant: (a) entered a soup kitchen located in Guro-gu Seoul Metropolitan Government G on the said day; (b) subsequently, the Defendant stolen Samsung Galthal 4 smartphones with the victim’s market value located on the floor between the victim C who is a customer and the victim C, at a level equivalent to one million won.
C. On August 3, 2015, the Defendant of larceny around 01:30 on August 3, 2015.
After entering the same place as Paragraph 1, the victim I, who is a customer, stolen Samsung Talle 2 smartphone, which is equivalent to KRW 700,000,00 in the market value of the victim's possession on the floor between the victim I and the victim I.
2. Fraud by using computers, etc.;
A. On July 1, 2015, around 16:30 on July 1, 2015, the Defendant purchased contents by means of entering settlement information into the small settlement outlet of the said smartphone without authority and paying a small amount of KRW 550,00,00 by using the smartphone in Samsung F, which was stolen, as set forth in paragraph 1(a), by using the smartphone in gallon, and by using the smartphone.
Accordingly, the defendant acquired financial benefits by inputting information without authority into a computer or any other information processing device.
B. On July 13, 2015, the Defendant was from July 13, 2015 to 04:08 of the same day from July 13, 2015 to the same day.
As stated in the foregoing paragraph, the victim C’s gallonization of Samsung Trithn by using Samsung Trith 4 Smartphones and by inputting the settlement information into the small settlement window of the aforesaid smartphone without authority. It extends over 27 times in total, such as the entry in the list of crimes.
