Defendant shall be punished by a fine of seven million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

The Defendant is the representative of the K Co., Ltd. in Daejeon Jung-guJ and the third floor of Daejeon, who runs the construction business by using six regular workers.

When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred.

Provided, That the date of payment may be extended according to the agreement between the parties in special circumstances.

Nevertheless, the Defendant worked for the aforementioned company from June 3, 2019 to July 10, 2019, and did not pay 3,500,000 won monthly wages of retired workers as well as 1,3 through 10, 12, 14, and 17 on the day of his/her retirement, within 14 days from the date of his/her retirement without any agreement on the extension of the due date between the parties concerned.

Nevertheless, the Defendant served under the above company from August 15, 2019 to December 4, 2019, and was retired from office, and the Defendant did not pay the total of KRW 13,322,581 to the above workers within 14 days from the date of retirement without an agreement between the parties on the extension of the payment date between the parties, as stated in the attached list M and N, as well as KRW 5,600,000, which was monthly wage of October 2019 of the retired workers M.
