Defendants shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

1. 피고인 A 피고인은 2013. 12. 17. 01:20경 상주시 C에 있는 ‘D’ 음식점 안에서 일행들과 술을 마시다가, 옆 좌석에 있던 피해자 B(36세)의 일행들과 시비가 되어, 손바닥으로 피해자의 뺨을 1회 때리고, 양손으로 멱살을 잡고 피해자를 밀쳐 바닥에 넘어뜨린 후 뒹구는 등 하여 피해자에게 약 6주간의 치료가 필요한 기타 경골 하단의 골절의 상해를 가하였다.

2. 피고인 B 피고인은 제1항 기재 일시, 장소에서 위와 같이 피해자 A(49세)으로부터 맞게 되자 양손으로 피해자의 멱살을 잡고 밀쳐 넘어뜨린 후 뒹구는 등 하여 피해자에게 약 6주간의 치료가 필요한 우측 주관절 내측 및 외측 측부 인대 완전 파열의 상해를 가하였다.
