Punishment of the crime

On July 27, 2007, the Defendant was sentenced to a fine of KRW 3 million for a violation of the Road Traffic Act (driving) at the Suwon District Court’s Eunpyeong site on July 27, 2007; on July 8, 2009, in the same court on the same offense, etc., 1.5 million won for a fine for the same offense in the same court on August 13, 2009; on December 12, 2014, in the same court, 5 million won for the same offense; and on June 16, 2015, a fine of KRW 3 million has been sentenced for the same offense in the same court.

【Criminal Facts】

1. On April 30, 2015, around 19:55, the Defendant driven a motorcycle under the influence of alcohol by 0.182% of the blood alcohol concentration, without obtaining a motorcycle driver’s license, from approximately 200 meters away from the road near Pyeongtaek-si in the parallel of Pyeongtaek-si to the road front of Pyeongtaek-si 90 “National Bank”.

Accordingly, the defendant, who has driven a motor bicycle more than twice, drives a motor bicycle under the influence of alcohol again, while driving a motor bicycle without obtaining a driver's license for a motor bicycle.

2. Around 09:40 on September 4, 2015, the Defendant driven a motorcycle without obtaining a motorcycle driver’s license in approximately 1km section from around the Pyeongtaek-si driving market to the front of the “non-exclusive park” as the Gyeonggi-si driving market from around 09:40 to around 2, 2015.

3. The Defendant violated the Guarantee of Automobile Accident Compensation Act, driving a motorcycle without purchasing mandatory insurance at the time and place specified in paragraphs (1) and (2).
