Punishment of the crime

The Defendant is a person who actually operates a restaurant called “C” in Sinpo City B.

In addition, a person who sells or provides agricultural and fishery products or the processed products thereof, such as the defendant, shall not make a false indication of origin or make an indication that may cause confusion with the country of origin.

However, from January 20, 2018 to October 2, 2019, the Defendant purchased approximately 112 gambling (total amounting to KRW 1,127 g, 975,800) domestically-in Korean traditional kimchi from Da “E” and offered and sold it in the restaurant operated by the Defendant, and the Defendant indicated the origin of the “flochi” as “domestic products” even though he indicated the “flochi” on the “flochi” bulletin in the restaurant, in spite of having indicated the “glochi” on the “glochi” bulletin, the Defendant indicated the origin of the “flochi” as “domestic products.”

Accordingly, the defendant made a mark that could cause confusion about the country of origin.
