The prosecution of this case is dismissed.

1. On June 14, 2020, at the entrance of the above church worship, the Defendant used the victim as the head of the C church located in Gwangju North-gu, Gwangju, and used the part of the victim D (the age of 39)'s elbows, who was guiding the believers at the entrance of the above church worship distribution on June 14, 202, and used the victim by cutting off the parts of the victim D (the age of 39)'s elbows toward the right elbows.

2. The facts charged in the instant case are the crimes falling under Article 260(1) of the Criminal Act, which cannot be prosecuted against the victim’s express intent under Article 260(3) of the Criminal Act.

According to the records and arguments, the victim may recognize the fact that he/she withdraws his/her wish to punish the defendant after instituting the prosecution of this case. Thus, the prosecution of this case is dismissed in accordance with Article 327 subparagraph 6 of the Criminal Procedure Act.
