1. The defendant shall be the plaintiff.
A. Of the land of 3,543 square meters in Gangdong-gu Seoul Metropolitan Government, indication 1, 2, 3, 4, 5, 6, 7, 8, 8, of the annexed drawings.
Reasons
1. Facts of recognition [based on recognition: Fact that there is no dispute, entries in Gap's evidence 1 through 6 (including both parties with virtual numbers), the purport of all pleadings];
A. On January 1, 2008, the Plaintiff entered into a lease agreement with D and Gangdong-gu Seoul E, Gangdong-gu, C land approximately 2,290, setting the lease term from January 1, 2008 to December 31, 2008, and thereafter the said lease agreement has been renewed until now.
나. 원고는 위 임차한 토지 중 서울 강동구 C 답 3,543㎡ 토지(이하 ‘이 사건 토지’라고 한다) 위에 철골조 비닐하우스를 시설하여 농작물을 재배하다가, 2008. 10. 13. 피고와 위 비닐하우스 중 별지 도면 표시 1, 2, 3, 4, 5, 6, 7, 8, 1의 각 점을 순차로 연결한 선내 ㈎부분 약 479㎡(145평) 지상 철골조 비닐하우스 1동(이하 ‘이 사건 비닐하우스’라고 한다)에 대하여 연차임 300만 원으로 정하고, 전대차기간은 정하지 아니한 채 전대차계약(이하 ‘이 사건 전대차계약’이라고 한다)을 체결하였다.
다. 피고는 이 사건 전대차계약을 체결한 후 이 사건 비닐하우스 내에 별지 도면 표시 2, 3, 6, 7, 2의 각 점을 순차로 연결한 선내 ㈏부분 약 99㎡ 지상 목조 및 철골 구조물(이하 ‘이 사건 구조물’이라고 한다)을 설치하여 이 사건 구조물에서 식물을 재배하거나 거주하였다. 라.
The Defendant paid 3 million won annual rent with respect to the instant sublease contract, and did not pay 5 or more years annual rent from October 13, 2009 to October 2009.
E. On August 7, 2014, the Plaintiff stated in the instant complaint that the instant sub-lease contract is terminated on the grounds of the Defendant’s delayed payment, and the duplicate of the instant complaint was served on the Defendant on August 7, 2014.
2. Determination:
A. According to the above facts of recognition, the sub-lease contract of this case was lawfully terminated on August 7, 2014, since the duplicate of the complaint of this case was served on the defendant.
