A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person engaged in fire-related construction works, etc. at Gangdong-gu Seoul Metropolitan Government Office and the first floor office underground.

1. A person who intends to conduct fire-fighting system installation business, such as public-use facilities in violation of the Act on the Construction Business of Fire-Fighting Systems shall register his/her fire-fighting system business with the competent Mayor/Do Governor

Nevertheless, the Defendant: (a) around December 6, 2013, without registering fire-fighting system design business and construction business; (b) around the design and construction of fire-fighting and safety facilities for the buildings Gangdong-gu Seoul Metropolitan Government; (c) around May 20, 2015, the design and construction of fire-fighting and safety facilities for the “F main store” located in Gangdong-gu Seoul Metropolitan Government E-5 story; and (d) on August 31, 2015, the Defendant engaged in fire-fighting and safety facilities business, such as designing and construction of fire-fighting and safety facilities for the “H” of Gangdong-gu Seoul Metropolitan Government G2 G (H).

Accordingly, the defendant was engaged in fire-fighting facility business without registering the fire-fighting facility business.

2. In the process of running fire-fighting facilities business related to public use facilities, such as Gowons and scoos, without registering the fire-fighting facility business from around 2013, the Defendant, as a private person, committed with the intent to forge the first official seal, etc. registered as a fire-fighting facility designer and affix the seal on the fire-fighting equipment, floor plan, etc. attached to the above report when reporting the installation of safety facilities, etc. to the competent fire station.

Accordingly, on December 2, 2013, the Defendant produced the official seal in the name of the professional engineer of the J and the seal in the name of the said (State) I employee K without authority at the Flux Office of M, and kept it in the above office of Gangdong-gu Seoul Metropolitan Government and the 1st floor office underground operated by the said Defendant.

Around December 6, 2013, the Defendant, at the Defendant’s office located in Gangdong-gu Seoul Metropolitan Government and the first underground floor, drafted a report on the installation of safety facilities, etc. of the Seoul Gangdong-gu Seoul Gangdong-gu Seoul Metropolitan Government D Building which the Defendant designed and constructed, and prepared the said report.
