Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

On February 9, 2017, the Defendant was sentenced to ten months of imprisonment with prison labor for fraud, etc. at the Suwon method sources, which became final and conclusive on April 26, 2017.

No person shall receive medical benefits or have a third party receive medical benefits by deceit or other unlawful means.

Nevertheless, on January 5, 2014, the Defendant received 15,950 won for medical care as D after receiving care accompanied by falchissis from a council member located in Seongdong-gu Seoul, Seongdong-gu, and received medical care benefits as if it were D, and thereafter received medical care benefits from June 27, 2016, as if it were D, as shown in the list of crimes in the attached Table.

Summary of Evidence

1. A protocol concerning the examination of the police officers of the accused;

1. A written confirmation of D facts;

1. Notification of detection of persons suspected of fraudulent receipt of health insurance, and a list of real-time medical treatment;

1. Previous convictions in judgment: Application of inquiry letter, such as criminal history, text of judgment, and Acts and subordinate statutes on the acceptance status of individuals;

1. Relevant provisions of the Act and Article 35 (4) 3 of the Act (Selection of penalty) of the Act concerning the relevant criminal facts as well as medical benefits for the choice of punishment;

1. After Article 37 of the Criminal Act, Article 39 (1) of the same Act:

1. The former part of Article 37 of the Criminal Act, and Articles 38 (1) 2 and 50 of the same Act, which aggravated concurrent crimes;

1. Article 70(1) and Article 69(2) of the Criminal Act to attract a workhouse;

1. Article 334 (1) of the Criminal Procedure Act concerning the order of provisional payment;
