The Defendants jointly and severally agreed with the Plaintiff KRW 100,000,000 and 3.3% per annum from August 1, 2019 to September 11, 2020.

1. The plaintiff's assertion

A. The Plaintiff, on December 31, 2016, interest rate of KRW 100,000,000, to Defendant B Co., Ltd.

3. 3.% and the due date set on March 31, 2017 were set and lent, and Defendant C guaranteed the said obligation.

B. However, Defendant B, while paying interest until July 2019, did not pay the principal as well as the interest thereafter.

C. Therefore, the Plaintiff seeks to jointly and severally pay the money stated in the purport of the claim to the Defendants.

2. According to each of the evidence Nos. 1 and 2 (including paper numbers), the facts alleged by the Plaintiff can be recognized.

Therefore, the Defendants are jointly and severally obligated to pay to the Plaintiff the amount of KRW 100,000,000 with 3.3% per annum under the agreed interest rate from August 1, 2019 to September 11, 2020, which is the date of the instant sentencing, and 12% per annum under the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from the next day to the date of full payment.

3. It is so decided as per Disposition by the assent of all participating Justices on the ground that the plaintiff's claim is justified.
