피고인은 2017. 9. 26. 17:55 경 부산 남구 C 아파트 103오 1201호에 있는 피고인의 주거지에서 피고인의 휴대 전화기의 D 아이디 ‘E ’를 이용하여 피해자 F( 여, 30세) 의 D 메신 져로 남성의 성기와 음모를 촬영한 사진 1 장을 전송한 다음 “ 하앍, 니 꺼도, 그냥 서로 공유”, “ 니가 본 고 춘 데, 서로서로 보는 거짓” 이라는 문자를 전송하고, 2017. 9. 28. 00:02 경 위 피고인의 주거지에서 마찬가지 방식으로 피해자의 휴대 전화기에 남성의 성기와 음모가 드러난 사진을 전송하고, “ 넌 안 줘도 되, 니가 먹은 거야, 무 발기” 라는 문자를 전송한 다음 같은 날 00:04 경 발기된 남성의 성기와 음모 사진 2 장을 연속하여 전송하였다.
