A defendant shall be punished by imprisonment for a term of one year and two months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On November 23, 2000, the Defendant issued a summary order of KRW 1 million as a crime of violating the Road Traffic Act, and on June 16, 2003, the Daegu District Court issued a summary order of KRW 2.5 million as a fine for a crime of violating the Road Traffic Act, and on March 28, 2005, issued a summary order of KRW 3 million as a fine for a crime of violating the Road Traffic Act at the Daegu District Court’s Daegu District Court’s Daegu District Court’s Branch on April 15, 2016, and issued a summary order of KRW 4.5 million as a fine for a crime of violating the Road Traffic Act.
1. Violation of the Road Traffic Act (Refusal of measurement) by the Defendant is the driver of the B Poter truck.
피고인은 2019. 11. 17. 17:49경 위와 같이 음주운전 금지 규정을 위반한 사실이 있음에도 불구하고, 충남 태안군 C에 있는 D 부근 도로에서 위 포터 화물차량을 운전하다가 수로에 빠지는 사고를 내고, ‘포터가 수로로 빠졌다’는 112 신고를 받고 출동한 태안경찰서 E파출소 소속 순경 F으로부터 음주감지기 측정 결과 음주사실이 감지되고, 피고인으로부터 술 냄새가 나고 얼굴에 홍조를 띠는 등 술에 취한 상태에서 위 포터 화물차량을 운전하였다고 인정할 만한 상당한 이유가 있어 같은 날 18:10경부터 18:37경까지 4회에 걸쳐 음주측정에 응할 것을 요구받았음에도 불대를 손가락으로 막고 부는 시늉을 하고, 불대를 입 옆에 대고 들이마시는 등 정당한 이유 없이 경찰공무원의 음주측정 요구에 응하지 아니하였다.
Accordingly, the defendant violated the prohibition of drinking driving more than twice.
2. On November 17, 2019, the Defendant violated the Road Traffic Act (unlicensed driving) driving the B Poter Cargo within about 20 meters from the road front of the Defendant’s residence in the Chungcheongnam-gun G, Chungcheongnam-gun, Chungcheongnam-gun, without obtaining a driver’s license on November 17, 2019 to the roads near D located in the Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-gun.
