피고인은, 피해자 B이 피고인으로부터 빌려간 돈 중 20만 원을 갚지 않는다는 이유로, 2012. 6. 27. 피해자의 사진을 인쇄한 A4용지에 “빌려간 돈 입금 안하셨네요 계좌번호 아시죠 빨리 입금 부탁합니다!!!"라고 기재한 후 이를 서울 강북구 C 피해자의 집 현관문, 계단과 피해자의 차 및 피해자의 근무지에 부착하여 공연히 사실을 적시하여 피해자의 명예를 훼손하였다.
