A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On March 20, 2018, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Measures Taken after an accident) and the Road Traffic Act (hereinafter referred to as the “Aggravated Punishment, etc.”): (a) around 02:05, the Defendant driven a B Ethp car and went along the road of the high speed speed 5 lane in the vicinity of the Jyangyang-gu, Seoyang-gu, Seoul; (b) while driving the vehicle along the five lane near the Jyang-gu, Seoul along the same one lane, the Defendant was under the influence of alcohol at 0.130% from his blood alcohol concentration; (c) while driving the vehicle at the same time, he was under the influence of the victim’s duty of driving the vehicle, such as a two-lane replacement of the passenger car at the right-hand side, without accurately operating the steering system; and (d) Defendant 2’s negligence in performing his duty of driving the vehicle at the right-hand side, such as a two-lane replacement of the passenger vehicle at the same time.

2. The Defendant violated the Road Traffic Act (drinking) and the Road Traffic Act (drinking without a license) without obtaining a driver’s license. The Defendant driven the said math car under the influence of alcohol 0.130% from the 20km away from the 312-2nd high speed road located in Mapo-gu Seoul, Mapo-gu, 312-2, to the roads adjacent to the above Sungsan River, which is the 20km-dong, Mapo-gu, 312-2, the day indicated in paragraph 1.
