Purport of claim and appeal
The first instance court.
Reasons
1. Details of the disposition;
A. On November 1, 1988, the Plaintiff entered the Army, and was discharged from military service on April 11, 1991 with the maturity of the hospital.
B. On July 25, 201, the Plaintiff filed an application for registration of a person of distinguished service to the State with the Defendant “mental disorders” (hereinafter “the instant wounds”) on the ground that: (a) the Plaintiff, at the time of the injury, was discharged from military service on the ground that the Plaintiff lost the Gong16A1 small gun while serving as G sentry’s position; (b) had been subject to a harsh treatment from an appointed soldier; (c) had been inflicted an injury, such as having been incurred from drinking, etc.; and (d) had been discharged from military service without meals and three-months; and (e) had been discharged from military service without having been discharged from military service for a three-month period.
C. On January 12, 2012, the Defendant rendered a non-applicable decision-making disposition against the Plaintiff on the ground that the instant wound did not prove that it occurred in connection with the military service, and that it was deemed that there was no proximate causal relation with the military service, and thus, did not constitute a causal relation with the military service. (hereinafter “instant disposition”).
[Ground of recognition] Facts without dispute, Gap evidence 2, Gap evidence 9 through 11, the purport of the whole pleadings
2. Whether the instant disposition is lawful
A. In light of the following: (a) the Plaintiff’s assertion was found to have been seriously affected by examination stress before entering the Plaintiff, but basically, was judged to be on active duty in a normal physical examination; (b) was suffering from cruel acts, such as sacrifies, while living in the military; and (c) immediately after discharge, a proximate causal relationship between the Plaintiff’s military life and the instant wound is presumed to exist.
Even if there was a pre-entry symptoms of mental fission before entering the Plaintiff for domestic affairs, the Plaintiff left the place of a large sense of bullying due to a usual and passive nature, and the stress caused by military life is far more than the general public.
