Reasons
Punishment of the crime
[2014 Highest 400: Defendant A, from February 2004 to March 9, 2014, was a person who served as the representative director of Plaintiff I (hereinafter “instant company”) in Geumcheon-gu Seoul Metropolitan Government H building 910; Defendant B, around January 16, 2014, entered into a share sales contract with Defendant A and actually operated the instant company with Defendant A.
1. The Defendants’ failure to pay wages on March 5, 2014, including the Defendants’ failure to pay the total amount of KRW 1,629,80,00 on February 2014, which was paid by the LaborJ, from October 29, 2012 to April 9, 2014 at the instant company, and the total amount of KRW 1,629,80 on March 5, 2014, which was the date of the regular payment, to pay on March 5, 2014, as indicated in attached Table 8,11,14,16,17, 18, 19, 22, and 31, excluding the said nine workers among the 47 workers who were indicted for this part of this case, was revoked by having expressed their intention not to punish.
the total amount of KRW 17,122,010 for wages in February 2014 and for the settlement of accounts at the end of 2013 was not paid on March 5, 2014, which was the date of regular payment.
2. Defendant B’s non-paid Defendant B, on April 5, 2014, did not pay KRW 3,538,460 as wages for March 7, 2014 of K workers who worked from May 7, 2012 at the instant company, and KRW 4,307,70 as wages for March 5, 2014 for workers who worked from April 8, 2013.
3. Defendant B’s failure to liquidate money and valuables, and failure to pay retirement allowances, including that the sum of KRW 3,538,460, retirement allowances, KRW 4,701,790, annual average of KRW 456,850, and KRW 8,697,100, who worked for the instant company from December 9, 2010 to March 1, 2014, was not paid within 14 days from the date of retirement without agreement between the parties on the extension of the payment deadline, and that the amount of KRW 1 through 9,12 through 20, 22 through 24, 27 through 32, 34 through 39, 41, 42, 44 through 48, 50 through 54, 56 through 59, 61 through 77, 67, etc. of the attached list of crimes.
