A defendant shall be punished by imprisonment for six months.

Punishment of the crime

1. The Defendant’s “D” store in Gangdong-gu Seoul Metropolitan Government Defendant’s operation of Defendant C around November 6, 2008, when receiving money from the victim E, did not have the intent or ability to invest in the pharmaceutical company scheduled to be listed as soon as possible after developing new drugs, and the victim did not have the intent or ability to make an investment in the pharmaceutical company scheduled to list. The victim’s “I am and friendly professor requested the pharmaceutical company to manufacture new drugs and listed securities. I can see enormous profits if the investment is made at present. I will well bring about the teaching stories.” The Defendant obtained from the victim, namely, KRW 30 million from the victim.

2. On January 12, 2009, the Defendant, at the victim E’s house located in the F3rd floor in Gangdong-gu Seoul Metropolitan Government, and from around 2008, the Defendant, even though he/she borrowed money from the victim due to economic circumstances such as failure to pay the said D rents, he/she did not have the intent or ability to pay the rents, and, even if he/she borrowed money from the victim, he/she did not have the intent or ability to do so, he/she would drive down the rent rapidly. The Defendant, at the same time, obtained seven million won from the victim’s seat and acquired it by defrauded.

3. Around January 23, 2009, the Defendant stated that “D” was “A” and that, even if the Defendant borrowed money from the victim E due to economic circumstances such as failure to pay the above “D” from around 2008 due to the lack of payment of the rent, the Defendant acquired the money from the victim, i.e., nine million won, without having the intent or ability to pay it, and then acquired it by deception.”
