1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Details of the disposition

On December 27, 2006, the Plaintiff operated the “C Medical Care Center” (hereinafter “instant Medical Care Center”) which is a senior citizens’ long-term care institution in the former-term care institution in the North-U.S.-Gun, North Korea.

Around January 2014, the Defendant conducted an on-site investigation with non-military units for the period of investigation into the instant medical care center from December 2, 2010 to November 201, 2013; (i) as a result of a on-site investigation, the Defendant reported as a caregiver, from March 2, 2010 to October 31, 201; and (ii) reported as a caregiver, from September 1, 2012 to November 24, 2013; and (iii) reported as a physical care worker, the Defendant did not perform the caregiver’s duties in full charge; and (iv) reported as a physical care worker, for 90 days from March 18, 201, the Defendant did not actually work as a woman with a childbirth leave; and (v) requested for the allowance for benefits without reduction of the cost for benefits, thereby filing a claim for addition of additional medical care benefit costs in violation of the aforementioned guidelines.

Accordingly, the defendant recovered 50,027,800 won in total from the plaintiff.

In addition, on March 2015, the Defendant conducted an on-site investigation with respect to the instant medical care center from February 2, 2010 to January 2015, jointly with non-military units.

(hereinafter “instant on-site investigation.” On June 3, 2015, the Defendant calculated the amount to be recovered by excluding the amount already recovered, in the case of a part overlapping with the facts confirmed in the on-site investigation conducted on or around January 2014, pursuant to Article 43 of the Act on Long-Term Care Insurance for the Plaintiff based on the results of the instant on the instant on-site investigation with respect to the Plaintiff on the following grounds:

A disposition to recover expenses for long-term care benefits was taken.

(hereinafter “instant disposition”). Violation of the standards for placement of human resources for caregivers (1) G reported as caregivers shall be custodian from January 1, 2007 to January 12, 2014.
