Punishment of the crime
The victims of the name misscams, as an assistant of the so-called "scams", solicited the victims to withdraw and deliver money to the victims by telephoneing to the victims and misrepresenting them to the public prosecutor or the Financial Services Commission, etc., and the defendants misrepresenting their employees to the Financial Services Commission, and delivering documents in the name of the Chairman of the Financial Services Commission that are forged to the victims to receive cash from the victims and deliver them to the victims of the name misscams
On April 24, 2019 or next 25, the Defendant sent a false public document under the name of the Chairperson of the Financial Services Commission (hereinafter “Civil Service Act”) to the effect that “the Defendant would receive money from a person who has not been asked to receive money at a closed place.” After printing out documents under the name of the Chairperson of the Financial Services Commission, the Defendant sent the forged public document under the name of the Chairperson of the Financial Services Commission, “B,” a smartphone display, and printed it out to the end of Mapo-gu Seoul Metropolitan Government (hereinafter “B”).
1. Fraud;
A. On April 29, 2019, on the part of the victim C, the person who was unaware of the name of the crime committed against the victim C made a false statement to the victim C, stating, “A person who is in the process of arresting D using the passbook issued under the name of the party, and who is in the process of arresting other accomplices, shall withdraw all the money deposited in the new passbook to arrest other accomplices, and shall obtain a loan from a financial institution and deliver it to employees of the Financial Services Commission.”
However, the fact was that the false names, etc. were not the prosecutor or the employee of the Financial Services Commission, but the victim received money.
As above, the victims of false names, etc. deceiving the victim and induce the victim to deliver 12,100,000 won in cash to the defendant at least 15:15 on the same day prior to the withdrawal of 6 Nanaro-ro 40 in Yeongdeungpo-gu Seoul Metropolitan Government.
