A In four months of imprisonment, Defendant B shall be punished by imprisonment without prison labor for April, and Defendant C shall be punished by a fine of KRW 3,00,000.

Punishment of the crime

1. Defendant A and Defendant B are the field manager of C’s work site, a corporation that performs the “F” with the contract for KRW 1.79,162,270,000 from the Busan Traffic Corporation, and is the person in charge of safety and health of employees belonging to the above field.

Defendant

B under the trade name of G, a personal business owner who was awarded a subcontract for the said construction “Ful and related construction” from C to KRW 724,000,000,000 for the said construction work, and is a person in charge of the safety and health of employees belonging to the said site.

On July 20, 2015, the Defendants: (a) around July 20, 2015, had the victim I (the 60-year-old) and J perform the work of installing pipes for ventilation (venor) at the 1st floor below the above construction site located in the Busan Y; (b) the above work was conducted by having the victim I (the 60-year-old) and J conduct the work of installing a tent; and (c) the aforementioned work was at the risk of falling the said work site by a person, as a process of finishing the contact tape on the connected parts of the joint part of the connected parts, which are linked to the joint parts of the 3.1m height from the floor, and the joint parts (flexi) and the joint parts (difuser) connected to the said virtue.

In such cases, the Defendants had a duty to pay the safety cap and safety belt to workers, and to prevent the crash by installing a work board by means of assembling the vision, etc.

Nevertheless, the Defendants neglected to do so and neglected to wear the safety appearance and safety belt at the time, and neglected to leave the unstable A-type bridge under the ceiling to work on the ceiling, and caused the death of the two parts at the Busan National University Hospital located in the Seo-gu, Busan National University Hospital on July 24, 2016.

As above, the Defendants caused the death of the victim by joint occupational negligence.
