1. The Defendant shall pay to the Plaintiff KRW 447,821,863 and the interest rate of KRW 15% per annum from February 17, 2016 to the date of full payment.

Comprehensively taking account of the overall purport of the arguments in Evidence A Nos. 1 through 6, the Plaintiff is an individual entrepreneur engaged in the business of manufacturing gold and parts with the trade name “B,” and the Defendant is a company engaged in the business of manufacturing electronic parts; ② the Plaintiff supplied the Defendant with the penalty necessary for manufacturing electronic parts from January 31, 2015 to November 30, 2015; ② the amount was 498,512,080; ③ the Defendant paid KRW 50,690,217, which is part of the above payment, to the Plaintiff on December 31, 2015; ③ the Defendant paid KRW 447,821,863 (=498,512,080 -50,690,217).

According to the above facts of recognition, the defendant is obligated to pay to the plaintiff 447,821,863 won unpaid and delay damages calculated at the rate of 15% per annum from February 17, 2016 to the day of full payment, as requested by the plaintiff, following the delivery date of the original copy of the instant payment order, to the day of full payment.
