A. On June 29, 2012, the Plaintiff and the Defendant concluded a supervision service contract (hereinafter “the instant first contract”) with respect to housing redevelopment improvement projects implemented in the 149 North Asia-dong, Seodaemun-gu, Seoul (hereinafter “instant project”) in the 149 North Asia-3 Urban Renewal Promotion Zone (hereinafter “instant project”).

Article 13 (Commencement of Supervision Services) (1) of the terms and conditions of a housing construction work supervision service contract shall commence the supervision service in consultation with a project undertaker on the date of the commencement of supervision service prescribed in the contract, and at the time of commencement, a report on commencement including the following matters shall be

1. A plan for performing supervisory duties;

2. A project undertaker shall give a supervisor an instruction on the commencement of supervision services not later than seven days before the date of the commencement of supervision services as stipulated in the contract at the latest;

Provided, That where a supervisor is unable to commence supervision services due to any cause attributable to the project undertaker, the project undertaker shall notify the supervisor of the time of commencement and the time of entry, etc. of the actual site supervision supervisor not later than 14 days prior to the date of commencement of the actual supervision
